BREITLING COMPLIMENTARY WARRANTY EXTENSION TERMS AND CONDITIONS

These Terms and Conditions outline the terms of Breitling’s Complimentary Warranty Extension (“Complimentary Extended Warranty”) and constitute a contract between you, the customer, and Breitling (as defined below). The benefits of the Complimentary Extended Warranty are in addition to those provided under Breitling’s standard manufacturer warranty (“Breitling International Warranty”) and do not affect your statutory rights under applicable consumer law, which remain unchanged. 

By completing the registration process for your Complimentary Extended Warranty, as outlined in these Terms and Conditions, you acknowledge and agree to be bound by them. 

1. INFORMATION ABOUT US  
   
   The Complimentary Extended Warranty is provided by Breitling SA, a company registered in Switzerland under registration number CHE-102.177.526, with its principal office at Léon Breitling-Strasse 2, 2540 Grenchen, Switzerland, or by the relevant entity that entered into the purchase agreement with you for your Breitling watch, as specified on your invoice, receipt, or order confirmation email (referred to as "Breitling").

2. BREITLING WARRANTY EXTENSION  
   The Complimentary Extended Warranty is a free commercial guarantee offered by Breitling, covering manufacturing defects in Breitling watches in accordance with the terms, conditions, and limitations set out in these Terms and Conditions. It extends the coverage provided by the Breitling International Warranty and is only available in certain countries. Please check Schedule 1 to see if your country is included. Breitling may update this list at any time. 
   
   While the Complimentary Extended Warranty offers additional warranty coverage at no extra cost, Breitling reserves the right to modify or withdraw this offer at any time. This Complimentary Extended Warranty is not available indefinitely and may be discontinued at Breitling’s discretion. However, any warranties that have already been activated and confirmed will remain valid through their original expiration date and will not be impacted by such changes. 
   
   The Complimentary Extended Warranty is provided in addition to any contractual, statutory, or common law warranty to which you may be entitled under applicable local law. These rights, including your statutory rights under consumer protection laws, remain unaffected by the Complimentary Extended Warranty. 
   

3. HOW TO ACTIVATE YOUR COMPLIMENTARY EXTENDED WARRANTY? 
   
   To qualify for our Complimentary Extended Warranty, you must: 
   - Purchase a new, genuine Breitling watch from one of the following: (i) official Breitling website; (ii) Breitling’s Concierge Service by phone; or (iii) an official Breitling boutique, authorized wholesale partner, or Breitling outlet (see list here: https://store.breitling.com/). This Complimentary Extended Warranty does not apply to used or refurbished Breitling watches;  
   - Register (activate) your new Breitling watch in the ‘My Account’ section on the Breitling website, making sure it is still covered by a valid Breitling International Warranty at the time of registration; and 
   - Subscribe to Breitling’s newsletter and maintain an active subscription for the entire duration of the warranty period to stay eligible for the Complimentary Extended Warranty. 
   
   Once Breitling confirms that all required conditions have been met, your Complimentary Extended Warranty will be activated. Breitling reserves the right to verify your registration and eligibility at any time. If the conditions are not satisfied, Breitling may refuse your registration and/or reject any related warranty claims. 
   

4. WHEN DOES THE COMPLIMENTARY EXTENDED WARRANTY START AND FOR HOW LONG?   
   
   If successfully activated, the Complimentary Extended Warranty will take effect the day after the expiration of the Breitling International Warranty for your Breitling watch. Even if activated earlier, it will only become effective once the Breitling International Warranty has expired. 
   
   Duration of your Complimentary Extended Warranty:  
   -Mechanical Manufacture Breitling Movement: if your Breitling watch is equipped with a Mechanical Manufacture Breitling Movement (models with names starting with "B" followed by two digits between 01 and 35, e.g., B01 to B35), the Breitling International Warranty is extended by an additional 3 years.  
   -Other Movements: for Breitling watches with any other movement, the warranty is extended by an additional 2 years.  
   
   To keep your Complimentary Extended Warranty valid, water resistance tests must be performed every two years from the date of purchase. This test must be carried out at an authorized Breitling Service Centre and is offered free of charge. 5. WHAT IS NOT COVERED BY THE COMPLIMENTARY EXTENDED WARRANTY?  
   
   The Complimentary Extended Warranty does not cover the following:   
   - Theft, loss, acts of God, or natural disasters;  
   - Accidental damages such as blows, shocks, or crushing;  
   - Damage resulting from mistreatment or improper use;  
   - Damage resulting from any tampering with the watch by any party other than an authorized Breitling Service Centre;  
   - Damages to straps other than defects of metal bracelets;  
   - Wear and tear from normal use and ageing of the watch and/or the metal bracelet and buckle or clasp;  
   - Any routine services as per the recommended service plan of your watch;  
   - Repairs of a watch requested while the warranty has not been activated; and   
   - Water resistance problems and their consequences (except for watches with a mechanical Manufacture Breitling Movement, where water resistance problems are covered if water resistance tests have been performed every two years). 
   
   If any of the above conditions apply, or if any other provision of these Terms and Conditions is violated, your Breitling watch may not be eligible for coverage under the Complimentary Extended Warranty, and Breitling may reject your claim. Please note that the same exclusions that apply to the Breitling International Warranty also apply to the Complimentary Extended Warranty. These exclusions are detailed in the Breitling International Warranty documentation provided at the time of your watch purchase, and further information can be found at the following link: https://www.breitling.com/zz-zz/service/warranties/. However, these exclusions do not affect your statutory rights under applicable consumer law. 
   

6. WHAT SHOULD I DO IF MY BREITLING WATCH NEEDS SERVICE?  
   
   If you wish to make a claim under the Complimentary Extended Warranty, contact us using the methods below and provide information about your Breitling watch and the details of your claim:

   We will review your claim and provide instructions on the next steps. If we are unable to assess your claim with the information provided, we will notify you and request additional details. Please provide any requested documentation or information as instructed. Once your claim is validated, we will guide you through the process and offer one of the following options:  
   
   Repair: your Breitling watch will be repaired at no additional cost to you, covering both labor and spare parts. 
   Replacement: If repair is not possible, we will offer a replacement Breitling watch at no additional cost. This replacement may be the same model or a Breitling product of equivalent or higher value. If you choose a higher-value replacement, you will be required to pay the difference. Once a replacement is confirmed, the original Breitling watch submitted for service will be retained by Breitling. 
   
   Breitling will determine whether repair or replacement is the most appropriate solution and will inform you of the steps to send your Breitling watch to the authorized Breitling Service Centre, including any relevant shipping or additional costs. Please note that only repair or replacement is offered (no cash compensation will be provided) and that in the event of a replacement, the original Breitling watch submitted for service may be retained by Breitling. To maintain the validity of your Complimentary Extended Warranty, all servicing and repairs must be performed exclusively by an authorized Breitling Service Centre and in accordance with these Terms and Conditions. Services covered under the Complimentary Extended Warranty will not extend or restart the warranty period. Any spare parts replaced during a repair will be covered only until the original Complimentary Extended Warranty period expires. 
   

7. WHAT ARE THE LIMITATIONS OF BREITLING’S LIABILITY?  
   
   Notwithstanding anything to the contrary in these Terms and Conditions, certain laws and regulations may confer non-excludable consumer rights, guarantees, implied warranties, conditions, or impose statutory obligations on us that cannot be excluded, limited or modified. If such laws apply to you, some or all of the exclusions and limitations below may not apply, and you may have additional legal rights. We do not exclude or limit our liability where it would be unlawful to do so. Subject to the above:  (a) We shall be liable, regardless of the legal basis, only in cases of willful misconduct or gross negligence. In cases of simple negligence, and subject to mandatory applicable law, our liability is limited to damages arising from death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or for matters for which it would be unlawful to exclude or attempt to exclude liability. In all such cases, our liability shall be limited to compensation for damages that are foreseeable and typically arise under the given circumstances.  (b) In no event shall Breitling be liable for any indirect, special, incidental, or consequential damages arising in connection with the Complimentary Extended Warranty, including, but not limited to, loss of profits, business interruption, or any other losses that were not foreseeable at the time of contract formation. (c) In no event shall our total liability exceed the purchase price paid for the Breitling watch covered by the Complimentary Extended Warranty. This includes any loss directly resulting from our non-compliance, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise, to the extent such loss was a foreseeable consequence of that non-compliance.   Breitling shall not be liable to provide coverage under this Complimentary Extended Warranty where such coverage would contravene applicable sanctions laws or regulations, or would expose Breitling, its parent company, or its ultimate controlling entity to penalties under such laws or regulations. 
   

8. GENERAL PROVISIONS  
   
   This Complimentary Extended Warranty is offered by Breitling at its sole discretion. Breitling reserves the right to modify or terminate these Terms and Conditions, including the offer itself, at any time. Any changes will be communicated through official channels and will not apply to claims made prior to the change. We may periodically update these Terms and Conditions and will notify you in a reasonable manner, such as by posting the updated version on our website. For significant changes, we may also contact you directly, for example by email. By continuing to use the service after the changes take effect, you agree to the updated Terms and Conditions. The date shown on this document reflects when these Terms and Conditions were last revised. If any provisions of these Terms and Conditions are declared void or partially invalid, the remaining provisions shall remain in full force and effect. To the extent permissible by applicable law, any invalid provisions will be replaced by the relevant legal provisions under Swiss law, including those not explicitly outlined in these Terms and Conditions. A waiver by Breitling of any breach of these Terms and Conditions shall not be interpreted as a waiver of any other or subsequent breach. Breitling may transfer or delegate any of its rights and responsibilities under these Terms and Conditions, either fully or partially. However, you are not allowed to transfer these Terms or your rights to anyone else unless Breitling gives you explicit permission. 
   
   Unless otherwise required by the mandatory laws of your country of residence, these Terms and Conditions, as well as any dispute, claim, or controversy related to them, shall be governed by the laws of Switzerland, without regard to its choice of law or conflict of law principles. Furthermore, you and Breitling agree to submit to the jurisdiction of the courts of Switzerland for the resolution of any dispute, claim, or controversy arising in connection with these Terms and Conditions. However, if applicable mandatory laws grant you the right to bring legal proceedings in your country of residence or require Breitling to do so, this provision will not affect those rights.
